Subscriber Agreement

Last Modified: October 26, 2026

The plain-language summaries included throughout this Agreement are provided for your convenience only and do not modify or limit the terms of this Agreement. The full legal text below each summary is controlling.

What This Agreement Covers

This Subscriber Agreement (“Agreement”) is a legal contract between you and CAEVO. It explains the rules for using our website, mobile application, and platform (together, the “Services”). By creating an Account, you agree to be bound by this Agreement, whether you use the free tier or a paid Subscription. This Agreement applies to all registered users. Our Website Terms of Use, available at caevo.ai/terms-of-use, govern general browsing of the CAEVO website by visitors who have not created an account. If you have an Account, this Agreement controls your use of the Services; to the extent there is any conflict between this Agreement and the Website Terms of Use, this Agreement governs.

By creating an Account, you accept this Agreement by checking an unticked acknowledgment box and selecting an “I Agree” or account-creation/purchase button. CAEVO retains a record of your acceptance.

Please read this Agreement carefully. If you do not agree, do not create an account or use the Services.

Key Terms

We use plain language throughout this Agreement, but a few terms have specific meanings:

“CAEVO,” “we,” “us,” or “our” means CAEVO LLC, the company that operates the Services.

“Services” means the CAEVO website (caevo.ai), web application, mobile application (when available), and all features, content, tools, functionality, and related services we make available through them, whether now existing or later developed. This includes, the Aging Well Hub, Caregiver Hub, Family Loop, Ask EVO, Family Ready Folder, Daily Care Log, Care Stage Library, Move Well, Nourishment Center, Aging Well Index, and all related tools, libraries, and resources.

“Account” means the personal account you create to access the Services.

“Subscriber” or “you” means any individual who creates an Account and agrees to this Agreement.

“Invited User” means a family member, caregiver, or other person you invite to participate in your Family Loop or to access shared features of your Account.

“Family Loop” means the consent-based connection layer within the Services that allows you and your Invited Users to share selected information with one another.

“User Content” means any information, data, text, files, documents, photos, messages, or other materials that you or your Invited Users upload, enter, or otherwise provide to the Services.

“Ask EVO” means the AI-powered companion feature within the Services that provides information and guidance based on available data sources.

“Subscription” means the paid plan you select to access certain features of the Services beyond those available in the free tier.

Eligibility and Account Creation

Who Can Use CAEVO

To create an Account, you must:

  • Be at least 18 years old;
  • Provide accurate, complete registration information; and
  • Agree to this Agreement and our Privacy Notice.

International Use

The Services and their content are intended for individuals located in the United States. The Services are not directed to, and CAEVO does not knowingly market or target the Services to, individuals located outside the United States. CAEVO makes no representation that the Services or their content are accurate, appropriate, or lawful outside the United States. If you access or use the Services from outside the United States, you do so on your own initiative and at your own risk, and you are solely responsible for compliance with local law. CAEVO may restrict or refuse access to the Services from any location in its discretion.

Your Account

You are responsible for keeping your login credentials (email, password, and any multi-factor authentication method) confidential and for using reasonable care to protect them. Do not share your password or authentication codes. You are responsible for activity that occurs under your Account to the extent it results from your acts or omissions or from someone you allowed to use your credentials. To the extent permitted by law, CAEVO is not responsible for losses resulting from your failure to protect your credentials or promptly report unauthorized access. If you believe someone has gained unauthorized access to your Account, contact us immediately at support@caevocare.com. Nothing in this paragraph limits CAEVO’s responsibility for its own breach of this Agreement or applicable law.

You may only maintain one Account per person. Accounts are personal and may not be shared with, sold, or transferred to another individual except as described in the Death, Incapacity, and Legacy Access section below. Under a Family plan, each participant maintains an individual Account; the paying Subscriber’s plan covers the Subscription fees for each linked Account. The Family plan does not create a shared login or a shared Account.

On a Family plan, the paying Subscriber is the contracting party for billing, plan selection, and plan-level administration. Each linked participant is also a Subscriber under this Agreement with respect to their own use of the Services and must independently create an Account and agree to this Agreement.

The paying Subscriber may remove a linked Account from the Family plan at any time, and may cancel the Family plan Subscription in its entirety in accordance with the Cancellation section. Removing a linked Account, or canceling the Family plan Subscription, ends CAEVO’s obligation to bill for the affected Account’s Subscription fees but does not delete the affected Account or its User Content. Each affected linked Account will convert to the free tier if eligible, subject to the free tier’s applicable feature limits, or will be suspended if no free tier is available for that Account type.

Invited Users and Family Loop

You may invite family members, caregivers, or other trusted people to connect with you through Family Loop. When you invite someone, they will need to create their own Account and agree to this Agreement.

Family Loop is consent-first. Each person who joins your Family Loop creates their own Account and agrees to this Agreement, and is a Subscriber under this Agreement with respect to their own Account and sharing decisions. You control what information you share with your Invited Users, and they control what they share with you, at the level of individual data categories (such as medications, appointments, or care logs), with a level of detail you choose for each category. No one sees more than the categories and detail level you have selected. You may change your own sharing settings for any category at any time through your Family Loop settings. Disconnecting an Invited User from your Family Loop entirely is available only to that Family Loop’s administrator, generally the person who first created the connection; if you did not create the connection, you may not be able to remove another participant’s access on your own and should contact CAEVO support for assistance. When an Invited User’s access is removed, the removal takes effect immediately, and the removed person’s access to previously shared content within the Services is revoked at that time, not only to information shared afterward; this does not affect copies the removed person may have separately downloaded, saved, or shared outside the Services before removal. Family Loop messages, family updates, care logs, and other shared information may be incomplete, delayed, or inaccurate. CAEVO does not verify the accuracy, completeness, or timeliness of information shared through Family Loop, and you should not rely on information shared by other users without independent verification. Do not rely on Family Loop content as medical, health, clinical, emergency, or professional-care advice; verify important information directly with the person involved or a qualified professional.

As the Subscriber, you are responsible for the invitations you send and for reviewing the permissions you grant through Family Loop. Keep those permissions current and revoke access when a relationship or caregiving role changes. Family members, caregivers, and other Invited Users are independent users of the Services. They are not CAEVO employees, agents, representatives, care managers, or professional advisers, and CAEVO is not responsible for their decisions, actions, omissions, misuse of shared information, or failure to act. You are not responsible for an Invited User’s independent actions merely because you invited that person, but you remain responsible for your own use of the Services and for instructions or information you provide through your Account.

Information About Others

If you enter information about another person into the Services (for example, a family member’s health conditions, medications, or contact details), you represent that you have obtained that person’s affirmative consent to provide their information to CAEVO, or that you have legal authority to act on their behalf (such as a valid power of attorney or legal guardianship), and that your provision of the information complies with all consent, authorization, and notice requirements under applicable law, including the Washington My Health My Data Act and other consumer health data privacy laws. You are responsible for ensuring that any information you provide about others is accurate and that sharing it with CAEVO is consistent with your legal obligations to that person. CAEVO does not verify and is not responsible for verifying whether you have obtained the consent or authority required by this section. You are solely responsible for any claims, disputes, or liability arising from your provision of information about others without the consent or authority required by this section.

Some users enter information about a person, such as a family member or care recipient, who is not a registered user of the Services and may never see this Agreement. Information about such a person is subject to the same privacy protections and data-handling practices that apply to information about registered users, as described in our Privacy Notice.

If you are a person about whom another user has entered information into the Services, you may contact CAEVO using the contact information in the Privacy Notice to request access to, correction of, or deletion of that information, or to object to its further collection, use, or sharing, whether or not you are a registered user. CAEVO will honor such requests to the extent required by applicable law, including the Washington My Health My Data Act, subject to CAEVO’s ability to reasonably verify your identity and your relationship to the information.

Subscriptions and Billing

Plans and Pricing

CAEVO offers different subscription plans with varying features and access levels. Before you subscribe, the checkout page and your Account dashboard will show the plan name, the exact amount due (including any applicable taxes), the billing cadence (for example, monthly or annual), the next renewal date, and any applicable trial or promotional terms. Paid Subscriptions renew automatically unless you cancel. By selecting a paid plan, providing payment information, and affirmatively agreeing to the renewal terms at checkout (for example, by checking an unticked box and selecting the purchase button), you authorize CAEVO and its payment provider to charge the disclosed amount to your payment method on each renewal date until you cancel.

Free Tier

Certain basic features of the Services are available at no charge through the free tier. We may change what is included in the free tier at any time by updating the Services. Free-tier access does not require payment information, but you must create an Account and affirmatively agree to this Agreement during the registration process. If you later choose to upgrade to a paid Subscription, you may do so through your Account dashboard or the checkout page; your continued use will remain subject to this Agreement, plus any additional terms disclosed at checkout.

Free Trials and Promotional Offers

Any free trial or promotion will disclose before you accept it (1) the length of the trial or promotional period, (2) the date on which it ends, (3) the plan and amount that will be charged after it ends, (4) the billing cadence, and (5) how to cancel. Unless you cancel before the stated conversion date, the Subscription will convert automatically to the disclosed paid plan and your payment method will be charged on that date. If an offer states a different conversion or billing rule, that offer controls. Founding member and other cohort-based promotional pricing is an introductory rate for the period disclosed in the applicable offer. It is not locked for the life of your Account and remains subject to the Price Changes section below.

Billing and Renewal

Paid Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on the plan you selected) unless you cancel before the renewal date. The amount and cadence for each renewal, and the next renewal date, will be shown at checkout and in your Account dashboard, clearly and conspicuously and in close proximity to the request for your payment information or renewal consent. You authorize CAEVO and its payment provider to charge the payment method on file for each renewal. Before each renewal, we will use commercially reasonable efforts to send you a renewal reminder to the email address associated with your Account with reasonable advance notice, stating the amount to be charged, the cadence, the renewal date, and how to cancel; we will also use commercially reasonable efforts to send a post-purchase acknowledgment or confirmation, including cancellation instructions, after you first subscribe or after a material change to your plan. CAEVO will present this disclosure using the same amount, cadence, and cancellation information at checkout, in the Account dashboard, in confirmation and reminder emails, and in any promotional or trial terms, so that you see consistent information about your Subscription across every surface. If your payment method fails, we may retry the charge or suspend access until payment is resolved. Cancellation stops future renewal charges but does not necessarily refund the current billing period, except as required by law or stated in the applicable offer.

Price Changes

We may change our Subscription prices from time to time, including prices for plans previously offered at a promotional, founding member, or other introductory rate. Any price change will apply prospectively only. If we increase the price of your plan, we will give you at least 30 days’ advance notice or any longer notice required by applicable law. The new price will not apply until the notice period ends and will begin with the next billing period after that date. We will not charge the new price if you cancel before the change takes effect. If applicable law requires renewed consent to a price change, we will obtain it before charging the new price.

Taxes

All prices displayed are exclusive of applicable taxes unless otherwise stated. You are responsible for any sales tax, use tax, or similar governmental charges imposed on your Subscription payments.

Cancellation

You may cancel your Subscription at any time using the cancellation control in your Account settings or, if we state another method for your plan, by using that method or contacting us at support@caevocare.com. The cancellation process is simple to find and complete and does not require more steps than reasonably necessary. Cancellation stops future renewal charges and takes effect at the end of your current billing period; you will continue to have access to paid features until that date. Unless required by applicable law or stated in the offer you accepted, cancellation does not entitle you to a refund or prorated refund for the current billing period.

Enterprise and Business Use

This Agreement covers individual, personal, consumer use of the Services only. If you want to use CAEVO on behalf of a business, employer, health plan, or other organization, you must enter into a separate written enterprise agreement with us. Contact sales@caevocare.com for more information.

Your License to Use the Services

Subject to your compliance with this Agreement and payment of any applicable fees, CAEVO grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes during the term of your Account or Subscription.

This license does not include any right to:

  • Copy, modify, distribute, or create derivative works from any part of the Services;
  • Reverse engineer, decompile, or attempt to extract the source code of any software used to provide the Services;
  • Sell, sublicense, rent, lease, or transfer access to your Account or the Services to anyone else;
  • Use the Services for any commercial, business, or resale purpose;
  • Remove or alter any proprietary notices, trademarks, or branding on the Services; or
  • Use any automated means (bots, scrapers, or similar tools) to access the Services.

All rights not expressly granted to you are reserved by CAEVO.

Acceptable Use

You agree not to use the Services in any way that:

  • Violates any applicable law or regulation;
  • Infringes the intellectual property or privacy rights of any person;
  • Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
  • Involves uploading viruses, malware, or other harmful code;
  • Attempts to gain unauthorized access to any part of the Services, other users’ Accounts, or CAEVO’s systems;
  • Interferes with or disrupts the Services or the servers and networks used to provide them;
  • Impersonates another person or misrepresents your identity or affiliation; or
  • Provides false, misleading, or inaccurate information about yourself or others.

We may investigate violations and may remove content, restrict features, or suspend or terminate your Account for conduct that we reasonably determine violates this section or is harmful to us, other users, or third parties.

Service Changes

We control how the Services are operated and may add, change, or remove features, tools, content, or functionality as the platform develops, including to address security, legal, or technical needs. We will try to give reasonable advance notice of a change that materially reduces the core functionality of a paid plan. If such a change materially reduces that core functionality, you may cancel your Subscription effective at the end of your current billing period.

Your Content

Ownership

You own your User Content. Nothing in this Agreement transfers ownership of your information, documents, health data, care logs, notes, messages, photos, or other content to CAEVO.

License to CAEVO

By uploading or entering User Content into the Services, you grant CAEVO a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, process, reproduce, display, transmit, and create derivative works from your User Content as reasonably necessary to:

  • Provide, maintain, and improve the Services for you and your Invited Users;
  • Operate features you have enabled (such as Family Loop sharing, Ask EVO responses, and Daily Care Log summaries);
  • Generate AI-assisted summaries, recommendations, outputs, and guidance based on your User Content, and display and deliver those outputs to you and your Invited Users within the Services; and
  • Comply with applicable legal obligations.

CAEVO does not use your User Content, health information, uploaded documents, Ask EVO conversations, prompts, or feedback to train or fine-tune AI models.

This license to your identifiable User Content exists for as long as your Account is active or as needed to fulfill the purposes above, plus any reasonable period needed to complete processing, comply with legal obligations, or wind down Services. When you delete content or close your Account, we will delete your identifiable User Content in accordance with our Privacy Notice, subject to any legal retention requirements. This license does not limit CAEVO’s rights in aggregated or de-identified data as described below, which survive termination.

Aggregated and De-Identified Data

We may create aggregated, anonymized, or de-identified data derived from your use of the Services (for example, statistics about how users navigate the platform, general trends in feature usage, or patterns in caregiving and aging-related topics). This data cannot reasonably be used to identify you. We own this aggregated and de-identified data and may use it perpetually for any lawful purpose, including operating, improving, and developing the Services; conducting and publishing research; creating and marketing new products and features; and publishing general statistics about aging and caregiving trends. CAEVO’s use of de-identified data is subject to the de-identification standards and re-identification prohibitions of applicable law, including the CCPA and the Washington My Health My Data Act.

CAEVO may use patterns, learnings, insights, and know-how derived from the operation of the Services and from aggregated or de-identified data to develop, improve, and enhance the Services and CAEVO’s business, and to develop new products and services. These rights are perpetual and survive termination of your Account. Nothing in this section permits CAEVO to identify you or disclose your personal information in violation of the Privacy Notice.

Your Responsibility for User Content

You are solely responsible for your User Content and any consequences of sharing it. You represent that:

  • You have the right to upload and share the content you provide;
  • Your content does not violate any law or the rights of any third party; and
  • Any content about other people is provided with appropriate authority or consent.

Feedback

If you provide suggestions, ideas, or feedback about the Services (“Feedback”), you grant CAEVO a perpetual, irrevocable, royalty-free, worldwide, fully sublicensable, and transferable license to use, reproduce, modify, create derivative works from, distribute, publicly display, and otherwise exploit that Feedback for any purpose without compensation or attribution to you. You are never required to provide Feedback.

AI Features and Ask EVO

How Ask EVO Works

Ask EVO is an AI companion that answers questions and provides guidance by drawing on available information in the following priority order:

  1. Your personal information and your family’s shared information within the Services;
  2. State-specific programs, rules, and resources relevant to your location;
  3. Trusted aging and caregiving sources (such as the CDC, NIH, CMS, AARP, the Alzheimer’s Association, and the National Council on Aging); and
  4. Broader AI knowledge and publicly available information as a last resort.

Ask EVO is powered by Anthropic’s Claude artificial intelligence technology. Prompts and responses are processed by Anthropic under commercial terms and are not used to train Anthropic’s models. CAEVO may change the underlying AI provider from time to time upon notice to subscribers. While we strive for accuracy, AI-generated responses may sometimes be incomplete, outdated, or incorrect.

Ask EVO and other AI-generated content are informational tools, not professional advice. AI features can produce responses that are inaccurate, incomplete, outdated, biased, inappropriate, or missing important context. CAEVO does not guarantee the accuracy, completeness, reliability, safety, or suitability of AI-generated content or any result from using it. Do not rely on Ask EVO for urgent or professional matters. Before acting on AI output, consult the appropriate qualified professional and, if the matter may be urgent, contact emergency or other professional services directly. See Important Disclaimers below for limits on using AI outputs for medical, legal, financial, benefits, or emergency decisions. We may update, modify, or discontinue AI features at any time as the underlying technology evolves.

Important Disclaimers

Do Not Rely on CAEVO for Medical, Health, Legal, Financial, Benefits, or Emergency Decisions

CAEVO is a caregiving and aging-well information and organization platform, not a healthcare provider, medical practice, care manager, insurer, benefits agency, law firm, financial institution, tax advisor, insurance agency, emergency service, or other professional-care provider. Do not rely on CAEVO, Ask EVO, the Services, platform content, Family Loop messages or family updates, Daily Care Logs, care-stage guidance, cost estimators, Medicare, Medicaid, or other public-benefits guidance, wellness, nutrition, movement, or brain-health content, legal information, AI outputs, or community content as medical, health, clinical, legal, financial, tax, insurance, benefits, emergency, or other professional-care advice. The Services do not diagnose, prescribe, treat, or provide clinical monitoring or triage, and they do not create a doctor-patient, nurse-patient, therapist-patient, attorney-client, fiduciary, insurer-insured, or other professional relationship. You are responsible for decisions you make and actions you take based on the Services and should obtain advice tailored to your circumstances.

No Care Management or Professional Services

CAEVO does not provide nursing services, clinical care, care management, case management, home care, in-home services, hands-on caregiving, emergency response, Adult Protective Services, crisis intervention, or other professional services. CAEVO does not act as your doctor, nurse, social worker, care manager, benefits counselor, attorney, financial advisor, insurance agent, or other professional adviser.

Before starting any fitness, movement, exercise, diet, nutrition, or wellness program found on or suggested by the Services, consult your physician or another qualified healthcare provider who knows your history. Do not change medication, treatment, diet, activity level, or care plan based only on the Services. If you have a medical emergency, mental health crisis, suspected overdose, fall, injury, or any other urgent situation, call 911 or your local emergency number immediately; CAEVO is not a substitute for emergency services.

CAEVO does not contact healthcare providers, insurers, pharmacies, care facilities, government agencies, benefits administrators, or other third parties on your behalf unless we separately agree to do so and receive any authorization or documentation we determine is required.

Legal, Financial, and Benefits Information

The Care Stage Library, Family Ready Folder, planning checklists, cost estimators, and information about housing, caregiving, financial, insurance, benefits, or other topics are general educational resources only, and none of it constitutes legal, financial, tax, investment, or insurance advice. CAEVO does not draft, generate, or provide executable legal documents, such as fillable advance directives or powers of attorney. The Care Stage Library and Family Ready Folder provide state-specific educational guidance on what legal documents exist, what they do, and what a given state requires, and route you to a licensed attorney to prepare or execute any document. This information, including any response from Ask EVO discussing legal, financial, tax, insurance, or benefits topics, is general in nature, is not tailored to your specific facts or circumstances, may not reflect the current requirements of your state or situation, and may become outdated, incomplete, or inaccurate due to changes in law, regulation, or program rules; CAEVO has no obligation to update it. No attorney-client, fiduciary, tax-preparer, or other professional advisory relationship is created by your use of these features or any related Ask EVO output. Before acting on any information from these features, consult a licensed attorney for legal questions or documents, a benefits counselor for public-benefits questions, and an appropriate licensed or qualified professional for financial, tax, investment, insurance, or related questions.

Medicare, Medicaid, and Benefits Information

Features that provide information about Medicare, Medicaid, government benefits, and caregiver compensation programs provide general educational information and estimates only. CAEVO is not affiliated with Medicare, Medicaid, Social Security, the VA, or any other government agency. CAEVO does not determine whether you or anyone else is eligible for Medicare, Medicaid, or any other public benefit; guarantee enrollment, coverage, payment, or any other benefit; or submit an application or appeal on your behalf unless we separately agree to do so in writing. Information about eligibility, enrollment, coverage, programs, and costs may change and may not fit your situation. Verify information with the relevant government program and consult a qualified benefits counselor or benefits/legal professional before relying on it.

Emergency and Safety Situations

CAEVO is not an emergency service, protective-services agency, crisis line, suicide-prevention hotline, or clinical triage service, and the Services are not designed to monitor emergencies or abuse. If you or someone you are caring for has a medical emergency, mental health crisis, suspected overdose, fall, injury, self-harm risk, or other immediate danger, or if you suspect elder abuse, neglect, exploitation, or another urgent safety issue, call 911 or your local emergency number, contact Adult Protective Services, the 988 Suicide and Crisis Lifeline, law enforcement, a crisis hotline, or another appropriate authority directly. Do not wait for a response from CAEVO or use Ask EVO, Family Loop, Daily Care Log, community posts, or any other CAEVO feature as a substitute for emergency, clinical, or protective services. Nothing in this section creates a duty for CAEVO to monitor, investigate, or report, except as required by law.

Not a Medical Record or HIPAA Service

CAEVO is a consumer caregiving and organization platform. The Services are not intended to create or maintain a medical record for use by a healthcare provider, and CAEVO is not acting as a HIPAA covered entity or business associate unless a separate written agreement states otherwise. Do not use CAEVO as a substitute for a provider’s medical-record system or required clinical documentation.

Wellness and Movement Disclaimer

Move Well, Nourishment Center, Aging Well Index, and other wellness features provide general guidance on physical activity, nutrition, brain health, and self-assessment. This content is not personalized medical treatment, diagnosis, or clinical monitoring, and individual results vary. You are solely responsible for determining whether any activity, exercise, or dietary approach is safe and appropriate for you. Consult your physician or another qualified healthcare provider before beginning any new physical activity, especially if you have existing health conditions, physical limitations, or are taking medications that may affect your ability to exercise safely.

BY USING THESE FEATURES, YOU ACKNOWLEDGE THAT PHYSICAL ACTIVITY, EXERCISE, DIETARY CHANGES, AND WELLNESS PRACTICES INVOLVE RISKS, INCLUDING INJURY, ILLNESS, OR DEATH. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU ASSUME THOSE RISKS WHEN YOU CHOOSE TO PARTICIPATE IN ACTIVITIES OR MAKE CHANGES BASED ON THE SERVICES, AND CAEVO IS NOT RESPONSIBLE FOR YOUR DECISION TO DO SO WITHOUT APPROPRIATE PROFESSIONAL GUIDANCE.

SMS, Push Notifications, and Reminders

CAEVO may offer SMS texts, push notifications, emails, or in-app reminders about medications, appointments, care tasks, wellness activities, payments, Subscriptions, or Family Loop updates. At this time, CAEVO sends only account and service messages and reminders you have opted into; CAEVO does not send marketing text messages. These are convenience features only. Messages may be delayed, inaccurate, incomplete, disabled, or missed because of device, network, settings, third-party, or other reasons. CAEVO does not monitor whether a message is delivered, read, or acted on, and you must not rely on CAEVO as a monitoring, medication-adherence, emergency, or safety-alert system. Confirm important information directly with the person involved or a qualified professional and use appropriate emergency or clinical services when needed. If we offer SMS marketing in the future, we will request any consent required by law, and you can stop marketing texts by following the instructions in the message. Stopping marketing texts does not stop necessary account or service communications. Message and data rates may apply.

Privacy

Our Privacy Notice, available at caevo.ai/privacy, explains how we collect, use, disclose, and protect personal information. Please review it carefully. If there is a conflict between this Agreement and the Privacy Notice about our personal-information practices, the Privacy Notice controls for that issue. If there is a conflict about use of the Services, this Agreement controls. By using the Services, you acknowledge that you have read and understand our Privacy Notice.

Support and Account Access

Customer Support

We provide support through email at support@caevocare.com and in-app help. Support is available Monday through Friday, Eastern Time. We will use reasonable efforts to respond to inquiries promptly, but we do not guarantee specific response times. We do not promise a particular uptime or availability level.

Support Access to Your Account

In order to help you with technical issues, troubleshoot problems, or respond to your requests, our support team may need to access your Account information. We will only access your Account data when reasonably necessary to provide support and will handle your information in accordance with our Privacy Notice and internal security policies.

CAEVO support staff do not have standing access to your health data, care logs, or Ask EVO conversations. When support access to that information is needed, it is granted on a just-in-time basis, scoped to the specific support issue, requires your approval, and is logged.

Family Ready Folder

The Family Ready Folder is an encrypted storage feature that lets you store documents (such as account statements, benefit letters, insurance summaries, and other reference materials) and usernames and passwords for third-party websites or accounts that you choose to save. The Family Ready Folder does not allow any third-party website or account to access or autofill your stored credentials, and CAEVO does not use those credentials to access or monitor third-party accounts on your behalf. The Family Ready Folder is encrypted, but CAEVO controls the encryption key: CAEVO and authorized CAEVO or CAEVO service-provider personnel with administrative access to the underlying database can decrypt and view the contents of your Family Ready Folder, including any stored passwords, and CAEVO may access that data as described in our Privacy Notice. If you share access to a profile with another Family Loop participant, that participant may be able to view the passwords and other contents stored in that profile’s Family Ready Folder, not only the documents. When you close your Account, we will delete your Family Ready Folder contents from our active systems; content already contained in routine system backups made before closure may persist in those backups until they are cycled out in the ordinary course.

Death, Incapacity, and Legacy Access

We understand that the information stored in CAEVO may be important to your family in the event of your incapacity or death. We are developing policies to address these situations thoughtfully and securely.

CAEVO intends to offer a legacy contact designation tool within your Account settings that will let you designate a legacy contact in advance and choose what that person will receive in the event of your death or incapacity: full access to your Account, an export of your User Content, or deletion of your Account and User Content. Once this tool is available, and to the extent permitted by applicable law, including the Revised Uniform Fiduciary Access to Digital Assets Act, your designation and instructions made through it will govern CAEVO’s disclosure of your Account and User Content, even if they differ from instructions in your will, trust, or other estate planning document. This designation tool is not yet available; until it is, the process described below applies to all Subscribers.

CAEVO will require the following before granting access to any Account: for a deceased Subscriber, a death certificate and documentation of legal authority to act on the estate’s behalf, such as letters testamentary or a court order; for an incapacitated Subscriber, a court order or a valid power of attorney that by its terms remains in effect during the Subscriber’s incapacity. A power of attorney terminates upon the Subscriber’s death and does not authorize access to a deceased Subscriber’s Account.

If family members or other parties dispute access to your Account, CAEVO will preserve the Account in a locked state and will not release any Account information until CAEVO receives a court order or a written agreement signed by all documented parties.

CAEVO does not automatically delete your Account or User Content upon your death.

Family Ready Folder contents are excluded from legacy access under this section and will not be released to a legacy contact, an estate representative, or any other party under any circumstances.

Community and Forum Features

CAEVO may offer community forums or discussion features where users can share experiences, ask questions, and support one another under a display name. If you participate in community features:

  • You are responsible for the content you post.
  • Do not share personal health information or private details about others without their consent.
  • Be respectful. Harassment, spam, hate speech, and commercial solicitation are prohibited.
  • CAEVO may moderate, edit, or remove posts that violate these rules or are otherwise harmful.

Community features are not designed or intended for medical emergencies, mental health crises, or reports of abuse, neglect, or exploitation. Do not use community features to report or respond to a medical emergency, a crisis involving self-harm or suicide risk, or suspected elder abuse, neglect, or exploitation; instead, contact 911 or your local emergency number, the 988 Suicide and Crisis Lifeline, Adult Protective Services, or another appropriate authority directly, as described in the Emergency and Safety Situations section above. CAEVO maintains an internal protocol for reviewing and escalating community posts that indicate a medical emergency, a crisis involving self-harm, or a disclosure of abuse, neglect, or exploitation, which may include removing the post, directing the poster and other affected users to appropriate resources, and, where CAEVO reasonably believes there is an imminent risk to health or safety, contacting emergency services or making a report where permitted or required by law. This protocol does not create a duty for CAEVO to monitor, discover, or respond to any particular post, and CAEVO’s ability to identify and act on such content depends on the post being detected through moderation or reported by a user.

Third-Party Services and Sources

The Services may contain links to third-party websites, integrate with or rely on third-party products and services, or present information sourced from third parties (including government agencies, nonprofit organizations, health authorities, payment providers, app stores, and AI providers). These third-party products, services, and sources are not controlled by CAEVO and may change or stop being available. We provide them for convenience and reference only. CAEVO may provide information about third-party resources, programs, providers, facilities, products, or services. We do not control those third parties and do not guarantee their availability, quality, licensing, safety, pricing, coverage, eligibility, acceptance, or results. You are responsible for evaluating and selecting any third-party resource or provider.

CAEVO does not receive referral fees, affiliate revenue, or paid placement from any third-party resource, provider, or product referenced in the Services. If any future arrangement involves compensation tied to a recommendation, CAEVO will disclose it prominently at the point of the recommendation.

We are not responsible for the accuracy, availability, security, or practices of a third-party product, service, or source, except as otherwise required by law. Your use of third-party services or products may be subject to their own terms and privacy policies, not this Agreement. If a third party changes or withdraws its product or service, a related CAEVO feature may be changed, limited, or discontinued.

Intellectual Property

The Services, including all software, designs, text, graphics, interfaces, trademarks, logos, and other content provided by CAEVO (excluding your User Content), are owned by or licensed to CAEVO and are protected by copyright, trademark, trade secret, and other intellectual property laws. Your right to use the Services is limited to the license granted in this Agreement. You acquire no ownership interest in the Services or CAEVO’s intellectual property by using them.

All rights in and to the Services not expressly granted to you in this Agreement are reserved by CAEVO. You acknowledge that the Services contain proprietary information and technology developed by or licensed to CAEVO, and you agree not to take any action inconsistent with CAEVO’s ownership of the Services and related intellectual property.

Suspension and Termination

Suspension by CAEVO

We may temporarily suspend your access to all or part of the Services, without prior notice, if:

  • We reasonably believe you have violated this Agreement;
  • Your use poses a security risk to the Services or other users;
  • We are required to do so by law, regulation, or legal process;
  • Your payment is past due (for paid Subscriptions); or
  • A third-party service provider on which the Services depend suspends access.

We will make reasonable efforts to notify you of any suspension and the reason for it. We will restore access as soon as the issue is resolved.

Termination by You

You may close your Account at any time by using the account-closure feature in your settings or by contacting us. If you have a paid Subscription, closing your Account also cancels your Subscription (see the Cancellation section above).

Termination by CAEVO

We may terminate your Account and this Agreement immediately if:

  • You materially breach this Agreement and do not cure the breach within 15 days after we notify you (or immediately for breaches that cannot be cured);
  • You engage in illegal activity through the Services; or
  • We discontinue the Services entirely (in which case we will provide at least 30 days’ advance notice and refund any prepaid Subscription fees for the period after the discontinuation date, unless applicable law requires otherwise).

What Happens After Termination

When your Account is closed or terminated:

  • Your license to use the Services ends immediately.
  • You will no longer have access to the Services or any content stored in your Account.
  • We will retain your User Content for up to 90 days after your Account is closed or terminated to permit reactivation and export, and we will use commercially reasonable efforts to delete it from our active systems thereafter in accordance with our Privacy Notice and applicable law.

Data Export

Before closing your Account, you may request an export of your User Content through your Account settings or by contacting support@caevocare.com. Documents and a readable summary of your information will be provided in PDF format, and structured data will be available in CSV or JSON format. We will make your requested data available for download for up to 90 days after your Account is closed, consistent with the data retention period described in our Privacy Notice. Export options may not include every feature, format, or item. After that 90-day period, we are not obligated to retain or provide access to your User Content except as required by law. See No Backup or Sole Record for important information you should keep independently.

No Backup or Sole Record

CAEVO is not a backup service or the sole place to keep important information. Keep independent copies of important legal, health, insurance, medication, financial, account, and credential information, especially information that is time-sensitive or legally important. Do not wait until Account closure or an emergency to make copies.

Warranty Disclaimer

We work hard to make CAEVO useful and reliable, but we cannot guarantee perfection. Please read this section carefully:

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, CAEVO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT OR INFORMATION (INCLUDING ASK EVO, AI-GENERATED CONTENT, FAMILY UPDATES, CARE LOGS, BENEFITS INFORMATION, COST ESTIMATES, WELLNESS CONTENT, LEGAL INFORMATION, OR COMMUNITY CONTENT) WILL BE ACCURATE, COMPLETE, CURRENT, SAFE, APPROPRIATE, OR SUITABLE FOR YOUR CIRCUMSTANCES. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR NEEDS, IDENTIFY OR SOLVE A CARE NEED, SECURE BENEFITS OR COVERAGE, OR PRODUCE ANY PARTICULAR HEALTH, CARE, LEGAL, FINANCIAL, OR OTHER RESULT. CAEVO MAKES NO WARRANTY REGARDING ANY THIRD-PARTY SERVICES, PRODUCTS, SOFTWARE, OR CONTENT INTEGRATED WITH OR ACCESSED THROUGH THE SERVICES, INCLUDING AI TECHNOLOGY PROVIDERS, AND DISCLAIMS ALL LIABILITY FOR SUCH THIRD-PARTY OFFERINGS.

Some states and other jurisdictions do not allow certain warranty exclusions or limitations, so some of the above exclusions may not apply to you. In that case, our warranties and obligations are limited to the minimum extent and shortest duration permitted by law.

Limitation of Liability

We want to be transparent about the limits of our responsibility. Please read this section carefully:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE EXCLUSIONS AND LIABILITY CAP BELOW APPLY TO CAEVO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS:

CAEVO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, SAVINGS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY CONTENT, INCLUDING ASK EVO, AI OUTPUTS, FAMILY LOOP INFORMATION OR UPDATES, CARE LOGS, BENEFITS INFORMATION, COST ESTIMATES, WELLNESS CONTENT, LEGAL DOCUMENT TEMPLATES, OR COMMUNITY CONTENT, OR ANY DECISION OR ACTION YOU TAKE BASED ON THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY LAW, CAEVO WILL NOT BE LIABLE FOR LOSS, CORRUPTION, UNAVAILABILITY, OR UNAUTHORIZED ACCESS TO YOUR DATA OR USER CONTENT, EXCEPT TO THE EXTENT LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

CAEVO’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE SERVICES, OR ANY CONTENT, WHETHER ASSERTED BY YOU OR ANY THIRD PARTY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CAEVO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE HUNDRED DOLLARS ($500).

Some states do not allow limitation of liability for certain types of damages. In those states, our liability is limited to the minimum extent permitted by law.

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WILL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. NOTHING IN THIS SECTION LIMITS ANY STATUTORY DAMAGES AVAILABLE UNDER THE TELEPHONE CONSUMER PROTECTION ACT OR ANY PRIVATE RIGHT OF ACTION UNDER THE WASHINGTON MY HEALTH MY DATA ACT, TO THE EXTENT SUCH LIMITATION IS NOT PERMITTED BY APPLICABLE LAW.

YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY, THAT THE DISCLAIMERS AND LIMITATIONS ARE REASONABLE AND APPROPRIATE GIVEN THE NATURE OF THE SERVICES AND THE FEES CHARGED, AND THAT THESE PROVISIONS FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND CAEVO.

Your Indemnification of CAEVO

You agree to defend, indemnify, and hold harmless CAEVO, its affiliates, and their respective officers, directors, employees, agents, successors, and assigns from any claims, demands, actions, investigations, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Services in violation of this Agreement;
  • Your User Content, including any claim that your content infringes or violates a third party’s rights;
  • Your violation of any applicable law; or
  • Your provision of information about another person without appropriate authority or consent, including any claim by the person whose information you provided or any third party arising from your disclosure of that information.
  • Any third-party claim arising from a decision, action, communication, disclosure, or omission by you or an Invited User based on information, content, guidance, or features available through the Services, except to the extent caused by CAEVO’s own breach of this Agreement or applicable law.

We will promptly notify you of any such claim and cooperate with your defense, but we reserve the right to participate in the defense at our own expense.

Dispute Resolution and Governing Law

IMPORTANT: UNLESS YOU OPT OUT, THIS SECTION REQUIRES INDIVIDUAL BINDING ARBITRATION AND WAIVES CLASS-ACTION AND JURY-TRIAL RIGHTS.

Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles.

Dispute Resolution

Except for the claims and proceedings identified below, you and CAEVO agree that any dispute, claim, or controversy arising out of or relating to this Agreement, the Services, or your relationship with CAEVO will be resolved by final and binding arbitration on an individual basis, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its consumer arbitration rules in effect when the arbitration is filed. Either party may bring an individual claim in small claims court if the claim qualifies; if the claim is transferred, removed, or appealed to another court, either party may require arbitration. Either party may also ask a court of competent jurisdiction for temporary, preliminary, or permanent injunctive or equitable relief to protect its intellectual property, confidential information, or the security of the Services or an Account from actual or threatened misuse, unauthorized access, or infringement. All other claims must be arbitrated under this section.

YOU AND CAEVO EACH AGREE TO BRING CLAIMS ONLY IN YOUR OR CAEVO’S INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CAEVO EACH WAIVE ANY RIGHT TO A JURY TRIAL FOR DISPUTES COVERED BY THIS SECTION. UNLESS BOTH SIDES AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT COMBINE CLAIMS OF DIFFERENT PEOPLE OR CONDUCT A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If the class-action waiver in this section is found unenforceable as to a particular claim or request for relief, that claim or request must proceed in court and not in arbitration, unless the parties agree otherwise in writing. The remainder of this arbitration agreement will continue to apply to all other claims.

You may opt out of this arbitration agreement and the class-action waiver by sending a clear written notice to legal@caevocare.com or to the mailing address identified in the Notices section of this Agreement, within 30 days after you first accept this Agreement. Your notice must include your name, the email address used for your Account, and a statement that you opt out of the arbitration agreement and class-action waiver. Opting out will not affect any other part of this Agreement. If you properly opt out, this arbitration agreement and class-action waiver will not apply to you, and disputes may be brought in a court of competent jurisdiction.

Informal Resolution First

Before starting an arbitration, you must first send us a written notice describing the dispute and the relief you seek at legal@caevocare.com and give us at least 30 days to try to resolve it. You and CAEVO agree to work in good faith during that period. This step does not prevent either party from seeking the temporary or emergency injunctive relief described above or bringing a qualifying individual claim in small claims court.

Changes to This Agreement

We may update this Agreement from time to time. When we make material changes, we will notify you by email (to the address associated with your Account) and by conspicuous in-app notification at least 30 days before the changes take effect. Material changes require your affirmative re-acceptance, such as through a clickwrap re-consent flow, before they apply to you. Continued use of the Services alone does not constitute your acceptance of a material change. If you do not agree to a material change, you may cancel your Subscription and close your Account before the change takes effect.

Notices

We may send notices related to the Services or your Account by email (to the address associated with your Account), by in-app notification, or by posting on our website. You are responsible for keeping your email address and other contact information current. For electronic-consent details and marketing opt-outs, see Electronic Communications below.

Electronic Communications

By creating an Account, subscribing, or using the Services, you consent to receive electronically, by email or through the Services, this Agreement, subscription confirmations, receipts, renewal notices, cancellation confirmations, service and security messages, changes to the Services or this Agreement, and other account-related notices and disclosures. You agree that electronic notices satisfy any legal requirement that they be in writing. Keep your email address and other contact information current. You may opt out of marketing communications by following the unsubscribe instructions, but you may still receive necessary service, security, billing, and account communications.

Notices to CAEVO should be sent to: CAEVO LLC, c/o its registered agent as listed in CAEVO’s then-current filing with the Indiana Secretary of State, Email: legal@caevocare.com. For general questions, contact support@caevocare.com or visit caevo.ai. Legal notices are effective when received.

App Store and Mobile Application Terms

The Services are distributed in part through the Apple App Store and Google Play. Apple Inc. and Google LLC are not parties to this Agreement and have no obligation whatsoever to furnish any maintenance or support services with respect to the Services.

In the event of any failure of the Services to conform to any applicable warranty, you may notify Apple or Google, as applicable, and Apple or Google will refund the purchase price, if any, paid for the Services to you; to the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the Services, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be solely governed by this Agreement.

Apple and Google are not responsible for addressing any claims by you or any third party relating to the Services, including, without limitation: (a) product liability claims, (b) any claim that the Services fail to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection or similar legislation.

Apple and Google are not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Services or your possession and use of the Services infringe a third party’s intellectual property rights.

You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Apple and Google, and their respective subsidiaries, are third-party beneficiaries of this Agreement with respect to the Services accessed through their respective platforms, and, upon your acceptance of this Agreement, each will have the right to enforce this Agreement against you as a third-party beneficiary.

If you access the Services through the iOS app, you acknowledge that your use is also subject to Apple’s Usage Rules set forth in the Apple Media Services Terms and Conditions.

General Terms

Entire Agreement

This Agreement, together with the Privacy Notice, the Website Terms of Use, and any plan-specific terms presented at checkout, constitutes the entire agreement between you and CAEVO regarding the Services and supersedes all prior agreements and understandings (written or oral) on the same subject. To the extent there is any conflict between this Agreement and the Website Terms of Use, this Agreement governs for registered users and subscribers.

Assignment

You may not assign or transfer this Agreement or any of your rights under it without our prior written consent. CAEVO may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, provided that the assignee agrees to be bound by the terms of this Agreement.

Export Controls and Sanctions

Do not use the Services in violation of U.S. or other applicable export-control or sanctions laws. You may not use or access the Services from a country or territory subject to comprehensive U.S. trade restrictions or if you are on a government restricted-party list, unless applicable law permits it. We may restrict access if needed to comply with law.

Force Majeure

CAEVO will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, internet or utility failures, or third-party service outages.

Severability

If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any provision of this Agreement is not a waiver of our right to enforce it in the future.

Survival

The following sections survive termination or expiration of this Agreement: Your Content (license grant and Feedback), Intellectual Property, Warranty Disclaimer, Limitation of Liability, Your Indemnification of CAEVO, Dispute Resolution and Governing Law, and this General Terms section.
